When someone dies intestate, their property must be distributed according to the rules of intestacy.

As a company, we receive queries about the rules of intestacy multiple times a day. That’s why we developed an easy-to-follow flowchart, relevant to intestate cases in England and Wales, which is available on request.

Only spouses or civil partners and close blood relatives on a descending scale can inherit under the rules of intestacy.

Also covered by the rules are cases of partial intestacy, where a valid will is in place but does not deal with all of the deceased’s estate. In partial intestacies, the rules apply only to the distribution of property which is not covered by the will.
